Driving Without a License in New York State

These are typical tickets that are issued for 'driving without a license.' In the middle left box of the ticket that says '509(1),' that would be the standard 'driving without a license' ticket that does not carry any points. This type of ticket is normally NOT reduced to a lesser charge and it will show up on your driver's record.

Even if you have a valid NYS driver's license but do not have it with you or can't find it when the intimidating cop has stopped you, you'll be issued this ticket. Once you go to Court, it will be dismissed.

The ticket that says '511(1)' is a ticket for 'aggravated unlicensed operation of a vehicle in the 3rd degree,' which covers motorcycles, scooters, all-terrain vehicles, boats, and yes, automobiles too. The definition is whether the driver 'knew or should have known that his/her driving privileges in NY were suspended or revoked.' This ticket is normally issued to drivers who have been previously issued at least one VTL 509(1) ticket in the past, it is also issued to those who are driving with a learner's permit (and nobody else that has a valid NYS driver's license is in the car at that time), it is frequently issued to drivers who have valid driver's license from Other states but it's obvious that the driver is living in NY on a permanent basis.

The ticket that says '511(2)' is 'aggravated unlicensed operation of a vehicle in the 2nd degree,' which like a '511(1)' is also an unclassified misdemeanor. It is a more severe type of driving infraction and normally is not reduced down to anything lower than a '511(1),' which means that you will have a misdemeanor conviction on your record, even though some people view this type of conviction as harmless. But in the end it will result in a criminal conviction.
